TAG GmbH: for Austria and Europe

Compliance with legal requirements is of utmost importance to us as a leading gas system operator in Europe. We think it is essential that everything we do is compliant not just with the law, but also with our own principles and values.

This section contains some useful information that we publish to fulfil our transparency obligations under Regulation (EC) No 715/2009 of the European Parliament and of the Council on conditions for access to the natural gas transmission networks, particularly Chapter 3 of Annex 1 to that Regulation, and Regulation (EC) No 1227/2011 of the European Parliament and of the Council on wholesale energy market integrity and transparency (the REMIT Regulation). We also provide our code of conduct for lobbying activities.

TAG Code of Ethics

The Code of Ethics describes the company’s fundamental values and is binding on all staff and external partners. It sets out our ethical standards and describes the rules, regulations and systems we apply to ensure that we do business professionally and responsibly.

All company bodies and employees of TAG GmbH engaging in lobbying activities act in accordance with the following principles:

  • All lobbying activity is carried out in accordance with the law, standards of public decency and the regulations implemented internally within TAG GmbH, notably the TAG Code of Ethics. Gleiches pdf
  • When making contact with officials for the first time, TAG representatives always introduce themselves, indicate their role and specify the matter they wish to discuss.
  • Any information required for the purposes of lobbying activities is always obtained in a fair and ethical way.
  • Such information is always communicated truthfully.
  • Any publicly known restrictions on an official’s activities and rules relating to conflicts of interest to which the official is subject are identified in advance and respected when carrying out lobbying activities.
  • Officials are never subjected to unfair or inappropriate pressure.

The Austrian Transparency Act for Lobbying and Interest Representation (Lobbying- und Interessenvertretungs-Transparenz-Gesetz, LobbyG) as amended defines lobbying as any organised and structured contact with public officials for the purpose of directly influencing certain legislative or executive decision-making processes in the federal government, the regions, municipalities and associations of municipalities.

Data protection

The purpose of this Privacy Notice is to inform you, as a data subject under applicable data protection law, about how TAG GmbH, Wiedner Hauptstrasse 120, A-1050 Vienna, company registration number FN 122567x (“TAG” or “we”) processes your personal data and about your rights in relation to that data.

We process your data because we are required to do so or because we consider it necessary. We make every effort to protect your privacy when processing your personal data. “Personal data” in this context means any information concerning an identified or identifiable natural person.

Personal data we collect from you

As a general rule, we do not collect any personal data when you visit this website, except for the data we need to store temporarily for the purpose of electronic communication. We collect data concerning you from you personally, from TAG systems used by you and from publicly available sources.
If your personal data is needed in order to perform a contract with you or your employer, we may not be able to perform that contract if you choose to withhold the above data. However, if you share your personal data with us voluntarily, i.e. on the basis of consent, you can withdraw that consent at any time without any effect on the services we provide to you. Sharing of data

We share your data to only a very limited extent. Your data may be visible to IT service providers who carry out maintenance on our systems. These providers have entered into a data processing agreement with us.
In addition, we share your data with banks, insurance providers and external advisors (lawyers, accountants, etc.) and with authorities and public bodies (such as E-Control, ACER, etc.) to the extent that this is necessary for business purposes or to fulfil legal obligations.
We will not share your data outside the EU.

Date security

Data retention

We will retain your personal data only for as long as necessary for the purpose concerned, or longer than this if any statutory retention period applies.

We will retain all personal data required for tax or business accounting purposes, i.e. books and records, as well as all business correspondence, for a period of seven years.

We will retain data required to establish or defend against any legal claims until the end of the limitation period for the claim concerned.

Although we make every effort to protect the security and integrity of your data, disagreements about how we use your data cannot be completely ruled out. If you think we have used your data unlawfully, you can file a complaint with the Austrian Data Protection Authority (www.dsb.gv.at).

Hosting and server log files

If you visit our website without registering or logging in, we will collect data about your visit and store it in server log files on the website server. The legal basis for this is our legitimate interest in accordance with Article 6(1)(f) GDPR.

The following data is logged:
IP address, date and time of query, time zone offset from GMT, content of the query, HTTP status code, volume of data transmitted, referring website, and browser and operating system information.

This information is needed to make our website work and ensure stability and security. We do this on the basis of our legitimate interest in accordance with Article 6(1)(f) GDPR.

Server log files are stored for a maximum of 7 days and are then erased. We store your data for security reasons, for example to investigate abuse. Data that we need to collect for evidence reasons will be exempted from erasure until the matter is fully resolved.

Business purpose

The purpose of the company is to operate a gas transmission system company connected with the Trans Austria Gasleitung, a pipeline system transporting natural gas from the Austrian-Slovakian border near Baumgarten/March to the Italian border near Arnoldstein (the “TAG gas pipeline”) as an independent transmission system operator in accordance with the Austrian Natural Gas Act 2011, Federal Law Gazette I no. 107/2011 as amended (“GWG 2011”).

The company has the right to undertake any activities which are useful or necessary for the accomplishment of its business purpose, including the acquisition, construction, expansion and operation of the necessary transport systems, conclusion of corresponding transport agreements and industrial, commercial and property transactions as well as all other appropriate associated or related activities, and to provide associated services to third parties.
